1.1 - All goods and services are sold in accordance with the EU Consumer Rights Directive (2011/83/eu). The purpose of this directive is to ensure that the consumer is given clear and accurate information about the goods and services supplied by the retailer to help give consumers confidence when buying online. Note: Goods and Services sold prior to the 13th June 2014 where sold in accordance with The Consumer Protection (Distance Selling) Regulations 2000 (SI 2000 No.2334).
1.2 - Use of this website constitutes acceptance of the terms and conditions laid out on this page. Staffordguitar.com reserves the right to amend these terms at any time, without warning. All changes will be made current on this page.
1.3 - All goods to be paid for by credit card or Bank Transfer. If you are shopping from outside the U.K. your credit card company will convert the transaction to your own currency.
1.4-Delivery of goods will only be guaranteed when forwarded to the address of the owner of the credit card. Delivery to an alternative address is at the owners risk and items lost during shipping will not be replaced.
2. Shipping & Handling.
2.1 - We will send your order within 3-5 days.
2.2 - The charge for carriage, where appropriate will be added automatically to your bill and will be displayed prior to you entering your credit card details.
2.3 - For orders that cannot be filled within 7 days, a full refund will be offered or you may back order the item. You will be informed by e-mail of the status of your order and the revised date of delivery.
2.4 - Goods damaged in transit must be reported via e-mail to Staffordguitar within 24 hours. Date and time of receipt and damaged sustained must be included. For customers outside of the U.K. you are responsible for any local Taxes and Duties applying to your country.
3. Damaged Goods
All orders are pre-checked and are well packaged before dispatch. However, in the event of goods arriving damaged, any shipping damage must be reported within 24 hours of receipt. A full replacement will be offered, or a full refund in the event that the goods are no longer in stock. We reserve the right to request additional photographic evidence in order to verify such claims. At the point of delivery, all goods become the responsibility of you the customer. From this point, you the Customer will be responsible for the safekeeping and correct use of all goods, Staffordguitar will not be responsible for any damage or fault arising from incorrect storage or use. The validity and conditions of any refund/return will be affected by any damage considered to be caused through misuse or neglect. We cannot be held responsible for damages caused by shipping or negligence if reported after 24 hours of the goods being delivered.
4. Cancellations & Returns - Online purchases only
4.2 - The right to cancel a contract and/or return goods to us as mentioned in Section 4.1 does NOT apply in the following situations:
4.2.1 - Financed Goods - Goods purchased on finance cannot be returned under the 14-days cooling off period. Financed goods are conditional based sales where the consumer is bound to purchase the goods from the outset but do not own the goods until they have fulfilled all conditions of the contract (typically through complete payment of all financial instalments).
4.2.2 - Special Orders - Any order which has been specified or customized to the customers specifications. This also includes any item which is not typically stocked by Staffordguitar and has been ordered in at the request of the customer.
4.2.3 - Health and Safety - any product that has come in contact with a customer's ear or mouth, such as microphones, headphones, earphones or product with a mouthpiece that have been used or where the hygienic seal has been separate or broken.
4.2.4 - Software, Media and CDs - where the packaging has been unsealed (unless the product is faulty) and copyright policies apply, any product registered via digital or physical means becomes immediately exempt for any returns.
4.3 - If you wish to exercise your right to cancel this contract within the cancellation period, you should return the goods to us within within 14 days and take reasonable care in doing as detailed in the EU Consumer Rights Directive (2011/83/EU). The risk and cost of returning the goods to us shall be accepted by you unless you have notified us that the goods have arrived damaged or faulty and this has been verified by us.
4.4 - As outline in the EU Consumer Rights Directive (2011/83/EU), failure to return items in their original condition will result in deducations from your refund or refusal of a return. As a result, we may make deductions to your refund for any diminution in value of the returned goods where the handling of goods has "gone beyond the sort of handling that might reasonably be allowed in a store"
4.5 - Upon cancellation of the contract we will credit your account with a full refund for the goods. Normally refunds are processed the same day if the goods haven't been dispatched or on the day of receiving the goods back, however, in any event, not later than 14 days after receipt of the cancelled goods. If you do not return the goods or do not pay the costs of delivery to us, we shall be entitled to deduct the direct cost of recovering the goods from the amount of the refund.
4.6 - Packaging must be marked "RETURNED GOODS RELIEF".
For customers outside of the U.K. you are responsible for any local Taxes and Duties applying to your country.
5.1 - New goods are guaranteed according to the manufacturers guarantee, as this differs between manufacturers, please ask for details.
5.2 - Damage due to exposure to liquids, moisture, heat, sunlight, radiation, pressure, fair wear and tear and damage caused by misuse or accident whilst in the possession or care of the customer are excluded. Cracks, splits, shrinkage and opening of joints caused by environmental changes and extremes of temperature or humidity whilst in the possession or care of the customer, are specifically excluded. Customers are advised to use a good quality hygrometer to monitor humidity levels of the environment in which guitars are kept.Replacement of consumable items such as strings is excluded.
5.3- Guitars are relatively fragile and prone to accidental damage, ensure you read our 'Guitar Care' notes supplied with every guitar. Some woods such as Brazilian rosewoods, Ziricote and Cocobolo used for some guitar bodies, commonly have surface cracks or ‘checks’. Although barely visible initially, it is normal and sometimes unavoidable that these become more noticeable or may open up over time. This is the nature of this material and making good of such movement is not covered by guarantee.
5.4 - Used or second-hand goods will be sold fit for purpose, however the making good of cosmetic defects, wear or repairs evident at time of customer inspection or as described in advertisement are not covered by guarantee.
